Overview
ListSide ("we," "us," or "our") operates listside.co. This Privacy Policy explains how we collect, use, and protect information when you use our platform — both as a real estate agent subscriber and as a member of the public visiting an agent's ListSide page.
Information We Collect
From Agent Subscribers
- Name, email address, and phone number provided at signup
- Billing information processed securely through our payment provider (we do not store card numbers)
- Profile photo and contact card content you choose to upload
- Listing content including property details, descriptions, and photos you upload
- Login credentials (passwords are hashed and never stored in plain text)
From Public Visitors (via Lead Generation Tools)
When a member of the public fills out a lead generation tool on any ListSide page, we collect the information they voluntarily submit, which may include:
- Name, email address, and phone number
- Property address (Home Value Estimator)
- Financial estimates entered into calculators (Net Profit, Mortgage, Rent vs Buy)
- Home preferences (Dream Home Wishlist, Buyer Readiness Quiz)
This information is stored in the ListSide lead database and delivered to the agent associated with the page you visited. Your information may also be made available to other licensed real estate agents on the ListSide platform through our lead pool and lead marketplace features, where agents may claim or purchase lead records. When an agent claims or purchases your lead record, your contact information and submitted data are transferred to that agent. By submitting a form on any ListSide page, you consent to this use of your information.
Data Enrichment and Third-Party Sourced Data
ListSide may supplement lead records with additional publicly available property and contact data obtained through third-party data providers, including property data APIs and skip trace services. This enriched data is provided to agents who claim or purchase leads through our platform. The enriched data may include estimated property ownership details, mailing addresses, and additional contact information derived from public records.
ListSide also sources certain lead records from third-party property data providers based on public records such as new construction permits, property ownership data, and listing activity. This means some individuals may have a lead record in our system even if they have never visited a ListSide page or submitted a form. If you believe you have a record in our system and wish to request its deletion, contact us at support@listside.co.
Automatically Collected Information
- Browser type and device information for compatibility purposes
- Pages visited and listing views for analytics purposes
- Authentication cookies to keep you logged in
First-Party Site Analytics
We also run our own basic analytics, hosted on our own servers, to understand which pages people visit and how well our own advertising is performing. This includes things like what page you're on, how you arrived at our site, how long you spend on a page, and whether you're a new or returning visitor. This data is never sent to or shared with Google, Meta, Reddit, or any other outside company, and it's never used to advertise to you elsewhere. Because no third party is involved, this isn't part of the Accept/Decline cookie banner described below, the same way our essential login cookie isn't. We're disclosing it here anyway in the interest of being fully transparent about everything we collect.
How We Use Information
- To provide, operate, and maintain the ListSide platform
- To process subscription payments and manage accounts
- To deliver lead information to the appropriate agent
- To make lead records available to agents through our lead pool and lead marketplace
- To enrich lead records with third-party data and deliver that enriched data to claiming or purchasing agents
- To send transactional emails (lead notifications, password resets)
- To improve the platform based on usage patterns via Google Analytics and to measure advertising effectiveness via the Meta Pixel
- To measure the performance of our own advertising campaigns and understand site usage through our self-hosted, first-party analytics
We do not use your personal information for our own advertising purposes. However, lead contact data submitted through ListSide tools is shared with and transferred to licensed real estate agents on our platform as part of our core service. See the Lead Marketplace section below for full details.
Lead Marketplace and Data Transfers
ListSide operates a lead pool and marketplace where licensed real estate agents can claim or purchase lead records. When you submit a form on any ListSide page, your information enters our lead database and may be transferred to one or more agents through this process. This is a core function of the ListSide platform and a material reason we are able to offer free lead generation tools to the public.
We are being transparent about this so you can make an informed decision before submitting your information. If you do not wish your information to be shared with agents beyond the one whose page you visited, do not submit a form, or contact us at support@listside.co to request deletion after the fact.
Cookies and Tracking Technologies
ListSide uses three categories of cookies. The first is a single functional cookie that has nothing to do with tracking or advertising: it simply remembers that you're logged in, and it's only set after you create an account or sign in, never just from visiting the site. The second is a pair of first-party analytics cookies that we use ourselves, on our own servers, to understand site usage and measure our own advertising, described below. The third category is third-party analytics and advertising tools (GA4 and Meta Pixel), which are off by default and only load if you actively choose "Accept" on the cookie banner shown on your first visit. If you choose "Decline," those tools never run.
- Essential authentication cookie: Not a tracking tool. This cookie is only set when you log in or create an account, it's never set just by browsing the site, and no third party receives it. It exists purely so you stay logged in instead of being signed out on every page. Because it isn't used for tracking or advertising, it isn't part of the Accept/Decline choice below, and there's nothing to opt out of.
- First-party analytics cookies: Set automatically when you visit the site, regardless of your cookie banner choice, because they involve no third party and no cross-site tracking. They let us tell first-time visitors from returning ones and measure how our own advertising is performing. This data stays on our own servers, is never sold or shared with anyone, and is never used to advertise to you elsewhere. See "First-Party Site Analytics" above for details.
- Google Analytics 4 (GA4): Loads only if you accept tracking. We use Google Analytics to understand how visitors interact with the platform. GA4 collects data such as pages visited, time on page, device type, and general geographic location. This data is sent to and processed by Google. Google may use this data in accordance with their own privacy policy. You can opt out by using the Google Analytics Opt-Out Browser Add-on.
- Meta Pixel: Loads only if you accept tracking. We use the Meta Pixel to measure the effectiveness of our advertising across Meta's platforms and technologies (which include Facebook, Instagram, Messenger, and Meta's broader advertising network), and to build audiences for ad targeting. The Meta Pixel collects data about your visit including pages viewed, actions taken, and device information, and sends that data to Meta Platforms, Inc. Meta may use this data for ad targeting and measurement, across any of its platforms and partner placements, in accordance with their own data policy. This means your visit to ListSide may be used to show you ads anywhere in Meta's advertising network, or to build audiences of people similar to you. You can opt out of Meta's use of this data by visiting Facebook Ad Preferences or through the Digital Advertising Alliance opt-out tool.
Under the CCPA, the use of the Meta Pixel and Google Analytics may constitute the "sharing" of personal information for cross-context behavioral advertising purposes. California residents have the right to opt out of this sharing, which you can do at any time by declining or withdrawing cookie consent. See the California Residents section of this policy for details.
To change your cookie choice at any time, click here to update your cookie preferences.
Data Retention
Agent account data is retained for the duration of the subscription and for a reasonable period after cancellation for billing and legal recordkeeping purposes. When an agent cancels their subscription, their lead data is permanently deleted from the platform. Lead data that has already been transferred to another agent through the lead marketplace prior to cancellation is not recalled. You may request deletion of your data at any time by emailing support@listside.co.
Data Breach Notification
In the event of a data breach that affects your personal information, ListSide will notify affected users within 72 hours of becoming aware of the breach, to the extent required by applicable law. Notification will be sent to the email address on file. We will describe the nature of the breach, the data affected, and the steps we are taking to address it.
Security
We use industry-standard security measures including encrypted passwords, HTTPS for all data transmission, and secure cloud hosting. No method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.
Children's Privacy
ListSide is not directed at children under 13 and we do not knowingly collect information from minors.
Changes to This Policy
We may update this Privacy Policy from time to time. We will notify subscribers of material changes via email. Continued use of the platform after changes constitutes acceptance of the updated policy.
DMCA and Intellectual Property Complaints
If you believe that content on a ListSide page infringes your copyright, please send a notice to support@listside.co with the following: a description of the copyrighted work, the URL where the infringing content appears, your contact information, and a statement that you have a good faith belief the use is not authorized. We will respond to valid DMCA takedown requests promptly.
Your Data Rights
Depending on your location, you may have rights including: the right to access data we hold about you, the right to request correction of inaccurate data, the right to request deletion of your data, and the right to object to certain processing. To exercise any of these rights, contact us at support@listside.co. We will respond within 30 days.
California Residents -- CCPA Privacy Rights
If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). We are disclosing these rights fully and plainly.
Categories of Personal Information We Collect
- Identifiers: name, email address, phone number, IP address
- Personal information under California Civil Code 1798.80: name, phone number, address
- Internet or electronic network activity: pages visited, tool interactions, analytics data collected via Google Analytics
- Geolocation data: general location derived from IP address via Google Analytics
- First-party site analytics: general visit data (pages viewed, how you arrived, time spent) and returning-visitor status, collected and retained only on our own servers
- Property and financial information voluntarily submitted through lead generation tools
- Enriched contact and property data from third-party data providers (for leads processed through our marketplace)
Purposes for Collection
- To connect members of the public with licensed real estate agents
- To operate the lead pool and marketplace features of the platform
- To analyze platform usage and improve the service
- To process agent subscriptions and provide platform access
Do We Sell or Share Personal Information?
Yes. Under the CCPA's broad definition, ListSide engages in the following activities that constitute the "sale" or "sharing" of personal information:
- Lead marketplace: When lead records are claimed or purchased by agents through our platform, personal information (name, phone, email, property data) is transferred to those agents in exchange for payment or platform credits.
- Google Analytics: Behavioral data from visitors on our public pages is sent to Google. Google may use that data for its own purposes, which qualifies as a "share" under CCPA.
- Meta Pixel: Visitor data including pages viewed and actions taken is sent to Meta Platforms, Inc. and may be used by Meta for ad targeting and audience building. This qualifies as a "share" of personal information for cross-context behavioral advertising under CCPA.
Our first-party site analytics (see "First-Party Site Analytics" above) is not included in this list. That data is collected and stored entirely on our own servers, is never transferred to Google, Meta, or any other outside company, and is never used to target you with ads elsewhere. It does not constitute a "sale" or "share" of personal information under the CCPA.
We are disclosing this plainly so California residents can make an informed choice about using the platform and submitting their information.
Your CCPA Rights
- Right to Know: You may request a full disclosure of the personal information we have collected about you, the sources, the purposes, and the third parties it has been shared with.
- Right to Delete: You may request that we delete your personal information. We will honor this request subject to legal exceptions.
- Right to Correct: You may request that we correct inaccurate personal information we hold about you.
- Right to Opt Out of Sale or Sharing: You have the right to opt out of the sale or sharing of your personal information. To exercise this right, email us at support@listside.co with the subject line "Do Not Sell or Share My Personal Information" and we will remove your record from the lead marketplace and flag it to prevent future transfers. Note that if your information has already been transferred to an agent prior to your request, we cannot recall it from that agent's records.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights.
To exercise any CCPA right, contact us at support@listside.co. We will respond within 45 days as required by law. We reserve the right to verify your identity before processing any request. Verification may require you to confirm the name, email address, and phone number associated with your record so we can locate it and confirm the request is legitimate.

Agreement to Terms
By creating an account and using ListSide, you agree to these Terms of Service. If you do not agree, do not use the platform.
Description of Service
ListSide provides real estate agents with a hosted platform to create a personal listing page, manage leads, and share lead generation tools with the public. The service is provided on a subscription basis.
Agent Responsibilities
- You are responsible for all content you post, including listing information, photos, and descriptions
- You must ensure that listing information is accurate and complies with applicable real estate laws and MLS rules in your jurisdiction
- You are responsible for how you use and handle leads generated through the platform
- You must comply with all applicable laws including CAN-SPAM, TCPA, and state real estate regulations when contacting leads
- You may not use the platform to spam, harass, or engage in deceptive practices
- You may not share your account credentials with others
Subscription and Billing
- Subscriptions are billed monthly and renew automatically
- You may cancel at any time — cancellation takes effect at the end of the current billing period
- Refunds are not provided for partial billing periods
- We reserve the right to change pricing with 30 days notice to subscribers
Intellectual Property
ListSide owns all rights to the platform, tools, design, and code. You retain ownership of content you create and upload (listings, photos, descriptions). By uploading content, you grant ListSide a limited license to display it on your public page.
Lead Marketplace Terms
ListSide operates a lead pool and marketplace where agents may claim or purchase lead records. By participating in the lead marketplace, you agree to the following:
- Lead records are provided as-is based on data collected from public form submissions and third-party property data sources
- ListSide does not guarantee the accuracy, completeness, or contactability of any lead record, including skip-traced contact information sourced from third-party providers
- All lead purchases are final. No refunds or credits will be issued for leads with incorrect, outdated, or unresponsive contact information. You are purchasing access to a data record, not a guaranteed contact or conversion
- You are solely responsible for how you contact and communicate with leads, and must comply with all applicable laws including TCPA, CAN-SPAM, and state real estate regulations
- You may not resell, redistribute, or transfer lead records purchased through the platform to any third party outside of your own licensed real estate practice
- ListSide reserves the right to modify lead pricing, pool rules, and marketplace features at any time with reasonable notice
ListSide is a technology platform and is not a licensed real estate broker, agent, or financial advisor. We are not responsible for:
- The accuracy of listing information provided by agents
- Any real estate transactions that result from use of the platform
- Financial decisions made based on calculator outputs
- How agents use or handle leads generated through the platform
- Any indirect, incidental, or consequential damages arising from use of the service
Our total liability to you shall not exceed the amount you paid us in the three months preceding the claim.
Prohibited Use and Automated Access
You may not use the ListSide platform for any of the following:
- Automated scraping, crawling, or harvesting of any data, leads, listings, or content from the platform without express written permission
- Submitting false or fraudulent lead information through any public-facing tool or form
- Using bots, scripts, or automated tools to submit forms, generate fake leads, or manipulate lead scoring
- Attempting to gain unauthorized access to any account, database, or backend system
- Using the platform to send unsolicited bulk communications or spam
- Reverse engineering, decompiling, or attempting to extract source code from any part of the platform
- Impersonating another agent, user, or entity on the platform
- Using the platform in any way that violates applicable law, including TCPA, CAN-SPAM, GDPR where applicable, or state real estate regulations
ListSide employs technical measures including rate limiting, honeypot fields, and IP monitoring to detect and prevent automated abuse. Accounts found to be engaging in prohibited use may be suspended or terminated without notice and without refund.
Indemnification
You agree to indemnify, defend, and hold harmless ListSide, its owners, employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the platform; (b) content you upload or transmit; (c) your communications with leads; (d) your violation of these terms; or (e) your violation of any applicable law or third-party right.
Disclaimer of Warranties
The ListSide platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any content, tool output, or lead information.
Termination
We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or are used in ways that harm other users or the public. You may cancel your account at any time.
Referral Program Terms
ListSide may offer a referral program that rewards agents for referring other agents to the platform. The following terms apply:
- Referral rewards are only issued upon confirmed paid conversion of the referred agent -- a referral that signs up but does not pay does not qualify
- Referral rewards are issued as platform credits or free subscription months and have no cash value
- ListSide reserves the right to modify, suspend, or terminate the referral program at any time
- Referral rewards may be withheld or reversed if fraud, self-referral, or abuse of the program is suspected
- Disputes regarding referral rewards must be submitted to support@listside.co within 30 days of the disputed event
Sales Representatives and Marketing Contractors
ListSide may engage independent sales representatives and marketing contractors to promote the platform. These individuals are independent contractors and not employees of ListSide. ListSide is not responsible for any representations, promises, or claims made by independent contractors that are not reflected in these Terms of Service or official ListSide materials. Any agent who is recruited or sold a subscription by an independent contractor agrees that their relationship with ListSide is governed solely by these terms, regardless of what was communicated during the sales process. Independent contractors agree to indemnify and hold harmless ListSide for any claims arising from misrepresentation or unlawful conduct in their promotional activities.
Force Majeure
ListSide shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: outages or disruptions from third-party data providers (including property data APIs and skip trace services), internet or cloud hosting outages, natural disasters, acts of government, or any other event outside our control. In such cases, we will make reasonable efforts to restore service as quickly as possible but will not issue refunds or credits for downtime caused by third-party service failures.
Governing Law and Dispute Resolution
These terms are governed by the laws of the State of Alabama. In the event of any dispute, claim, or controversy arising out of or relating to these terms or your use of the ListSide platform, both parties agree to first attempt to resolve the dispute through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place in Mobile County, Alabama. The arbitrator's decision shall be final and binding. You waive any right to participate in a class action lawsuit or class-wide arbitration against ListSide. If arbitration is found unenforceable for any reason, disputes shall be resolved exclusively in the state or federal courts located in Mobile County, Alabama, and you consent to personal jurisdiction in those courts.
Changes to Terms
We may update these terms from time to time. We will notify subscribers of material changes via email. Continued use after changes constitutes acceptance.

Mortgage Calculator Disclaimer
The mortgage payment estimates provided by the ListSide Mortgage Calculator are for illustrative purposes only. Actual mortgage payments will vary based on your credit score, lender, loan program, property taxes, insurance rates, HOA fees, and other factors not captured by this tool.
This calculator does not constitute a mortgage pre-approval, pre-qualification, or commitment to lend. Contact a licensed mortgage lender or financial advisor for accurate loan information specific to your situation.
Net Profit Calculator Disclaimer
The net proceeds estimates provided by the Net Profit Calculator are approximations based on information entered by the user. Actual proceeds from a home sale will depend on final negotiated price, actual closing costs, lender payoff amounts, title fees, transfer taxes, and other transaction-specific costs.
This tool is not a substitute for a formal net sheet prepared by a licensed real estate professional or closing attorney.
Rent vs. Buy Calculator Disclaimer
The Rent vs. Buy Calculator provides a simplified comparison based on user-entered assumptions. Real-world outcomes depend on market appreciation, interest rate changes, tax situations, opportunity cost of invested capital, and many other variables this tool does not account for.
This tool should not be used as the sole basis for a housing decision. Consult a financial advisor or real estate professional before making major financial decisions.
Home Value Estimator Disclaimer
The Home Value Estimator connects you with a local real estate agent who will provide a personalized valuation. This is not an automated valuation — it is a request for a human agent to review your property. Any valuation provided by an agent is their professional opinion and not a guaranteed sale price.
Lead Data Accuracy Disclaimer
Lead records available through the ListSide lead pool and marketplace are sourced from public form submissions and third-party property data and skip trace providers. ListSide does not independently verify the accuracy of any lead record, including contact phone numbers, email addresses, mailing addresses, or property ownership details. Data from skip trace services is derived from public records and may be incomplete, outdated, or incorrect. Agents purchase lead records understanding that the data is provided as-is with no guarantee of accuracy or contactability. No refunds or credits will be issued for leads that turn out to have inaccurate or unresponsive contact information.
Listing Information Disclaimer
Property listings displayed on ListSide pages are provided by individual real estate agents and have not been independently verified by ListSide. ListSide makes no representations or warranties regarding the accuracy, completeness, or reliability of any listing information. Buyers should conduct their own due diligence and consult with a licensed real estate professional before making any offer or purchase decision.
Not Financial or Legal Advice
Nothing on the ListSide platform constitutes financial, legal, tax, or investment advice. All tools, calculators, and content are for general informational purposes only. Always consult qualified professionals before making financial or real estate decisions.

SMS and Text Message Communications
ListSide operates a text messaging program that allows licensed real estate agents to communicate with leads who have opted in through a form submission on the agent's ListSide page. The following terms govern all SMS communications sent through or facilitated by the ListSide platform.
Opt-In and Consent
By submitting a form on a ListSide agent's page, you expressly consent to receive text messages from a licensed real estate professional regarding your inquiry. Consent is not a condition of any purchase. All forms include the following disclosure prior to submission: "By submitting, you may be contacted by a local real estate expert with personalized insights based on your request."
Message Types
You may receive the following types of messages:
- Follow-up messages from the agent whose page you visited regarding your real estate inquiry
- Responses to your questions or replies
- Informational messages related to your property search or home sale inquiry
You will not receive marketing messages from ListSide directly. All agent communications are the responsibility of the individual agent, not ListSide.
Message Frequency
Message frequency varies based on the nature of your inquiry and your interaction with the agent. You can expect to receive messages only in response to your form submission or replies.
Message and Data Rates
Standard message and data rates may apply depending on your mobile carrier and plan. ListSide and its agents are not responsible for any charges incurred through your mobile carrier.
How to Opt Out
You may opt out of text message communications at any time by replying STOP to any message you receive. After opting out, you will receive one final confirmation message and no further messages will be sent. To opt back in, reply START.

Supported Carriers
ListSide SMS is available on all major US carriers including AT&T, Verizon, T-Mobile, Sprint, and regional carriers. Carrier support is not guaranteed for all devices or plans.
Agent Responsibility
Individual real estate agents using the ListSide platform are solely responsible for ensuring their communications comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all applicable state and federal laws. ListSide provides the technical infrastructure for message delivery but does not control the content or frequency of agent-to-lead communications beyond the initial lead notification.
Email Communications
By submitting a form on a ListSide agent page, you may also receive email communications from the agent whose page you visited. You may opt out of email communications at any time by replying to any email and requesting removal, or by contacting the agent directly.
Transactional emails such as CMA reports and tool results are sent as a direct result of your form submission and are not marketing communications.
Do Not Call and Do Not Text
If you are registered on the National Do Not Call Registry, please be aware that by submitting a form and providing your phone number, you are providing express written consent to be contacted by a real estate professional regarding your inquiry, which may override DNC registry protections for that specific inquiry under TCPA exemptions for established business relationships and express consent.
